Maybe they did but its taken this long for everything to seep out into the public eye? Who knows, but yeah, it wont really matter for nintendo.

I also feel that this “Tornita Technologies” should have talked to Nintendo when they found out earlier. If they’re a Japanese company, odds are that they actually found about the 3ds earlier, potentially some time in March around when it came out, maybe earlier.
